摘要：El objetivo de este trabajo es analizar el cumplimiento del Derecho Comunitario por los Estados miembros da Unión Europea a través del estudio de la “Acción por incumplimiento”, establecida en los artículos 226 a 228 del TCE. Específicamente, el artículo presentará el concepto del incumplimiento, las fases del procedimiento y las innovaciones contenidas en el artículo 228 del TCE. A continuación, abordará la aplicación y el control de cumplimiento del Derecho. Por último, enunciará las consideraciones finales de la investigación. ABSTRACT The purpose of this paper is to analyze the fulfillment of the EC Law by the European Union Member States, studying the action for Member States “failure to fulfill obligations”, under the Treaty as framed in Arts. 226-228 EC. The article will present the conception of infringement, the phases of the procedure and the innovations of the article 228 of the EC Treaty. After, some aspects of the application and the control of the fulfillment of the law will be discussed. KEY WORDS: European Law, European Union, Infrigement Process
