摘要：O presente artigo analisa a crise vivenciada pelo Estado Providência na contemporaneidade e sua consequente substituição pelo Estado Penitência, que responde repressivamente às demandas das classes outrora beneficiárias das políticas sociais públicas, em um quadro social de pobreza agravada diante do fenômeno da globalização econômica e da exclusão de grandes contingentes populacionais do mercado de trabalho/consumo.Por fim, a partir da ideia central de profanação das instituições políticas modernas proposta por Giorgio Agamben, busca-se a formulação de possíveis soluções à crise, notadamente no que se refere à necessidade de se devolver o Welfare State à multidão, para que dele seja feito um novo uso, revitalizando-se as energias utópicas.
其他摘要：The article analyses the crisis the Welfare State currently goes through, and its consequent substitution by the Punitive State, which responds repressively to the demands of the classes that had been once benefited by the public social policies, in a social context of severe poverty facing the economical globalization, and the exclusion of a huge amount of people from the work/ consumer market. Finally, from the central idea of the profanation of the modern policies proposed by Giorgio Agamben, it seeks to formulate possible solutions to the crisis, notoriously on what concerns the necessity of giving back the Welfare State to the crowd, without exclusions, so that new usage can be made of it, starting from revitalizing the utopist energies.
