摘要：Toda regulação econômica setorial contém elementos de assimetrias de informação entre autoridade regulatória e regulados. Ao desempenhar suas atribuições de estabelecer regulamentos, medidas e ações que induzem e promovem o bem-estar econômico, o regulador rotineiramente encontra-se na situação de baixo nível informacional em virtude da escassez de dados, ou, o que é mais comum, baixa abrangência, nível de desagregação inadequado e parca qualidade da informação disponível. Assim, não é incomum observar reguladores desenhando regulamentos de maneira subótima. Adicionalmente, planos de investimentos na expansão da infra-estrutura básica de acesso ao mercado - recursos essenciais -, bem como a sua própria regulação, podem ser concebidos usando-se informação coletadas de forma imperfeita, ou seja, com ruído. Isso aumenta as incertezas inerentes à regulação - e também à implementação da política antitruste e às políticas governamentais – além de aumentar o custo dos investimentos setoriais. O presente trabalho visa estudar o caso das assimetrias de informação no setor de transporte aéreo. Maior ênfase é dada ao detalhamento dos esforços das autoridades do setor em realizar a regulação do provimento dos dados dos regulados, com vista a embasar a regulação e assistir ao consumidor em suas escolhas. Um estudo de caso do arcabouço de coleta, manuseio e disseminação dos dados setoriais implementados pelo regulador norte-americano, o US Department of Transportation (DOT). E por fim apresentar algumas propostas que poderão alterar a questão do provimento de informações por parte da ANAC, possibilitando assim maior fiscalização por parte da sociedade.Title in EnglishAsymmetric information and mandatory data disclosure by regulated firms: a case study of air transportationAbstract in EnglishAll sector economic regulation contains elements of asymmetry of information between regulatory authority and regulated. When performing their duties, the regulator routinely lies in low-level situation because of the scarcity of informational data, or, what is more common, spanning low, inadequate level of disaggregation and low quality of information available. Thus, it is not uncommon to observe regulators designing sub-optimal configuration way regulations. Additionally, plans for investments in basic infrastructure expansion of market access, as well as its own regulation, can be designed using information collected imperfectly. This increases the uncertainty inherent in the regulation, in addition to increasing the cost of the investment industry. This work aims to study the case of information asymmetry in the air transport sector. Greater emphasis is given to detailing the efforts of industry authorities carry out the regulation of the provision of regulated data, with a view to enhance the regulation and assist the consumer in their choices. A case study of framework of collecting, handling and dissemination of sector data implemented by North American regulator, the US Department of Transportation (DOT). And finally present some proposals that can change the question of provision of information by the ANAC, thus greater supervision by society.Paper language: Portuguese
