摘要：Este trabalho pretende abordar o artigo 2º, § 7º, da Lei nº 8.629/93, que exclui da política de assentamentos para fins de reforma agrária, todos aqueles que sejam identificados como participante de conflito agrário.Neste estudo, o primeiro passo será traçar um quadro da situação fundiária brasileira, e trazer a inovação da Constituição Federal de 1988, com o princípio da função social da propriedade para a discussão.Para formular uma visão crítica à exclusão promovida pela norma, utiliza-se a noção de Estado Democrático de Direito, construído por Jürgen Habermas, no intuito de assinalar a importância dos movimentos sociais na construção de uma política pública inclusiva e eficaz.
其他摘要：This paper approaches the article 2, § 7 of Brazilian
Law nº 8.629/93, which excludes of the public policy
for agrarian reform, those who are identified as a
participant of agrarian conflict. In this study, the first
step will show the Brazilian agrarian situation, and It
brings the innovation of the Brazilian Constitution of
1988, with the principle of the social function of the
property. To formulate a critical view about the
exclusion promoted by the law, we use the notion of
Democratic Rule of Law, built by Jürgen Habermas to
emphasize the importance of social movements in the
building of an inclusive and effective public policy.
