摘要：This legal report supports the unconstitutionality of article 365 of thechilean Criminal Code based on the violation of equality before the law, the principleof legality or "rule of law" (Lex certa), the right to a private life, and discrimination dueto sexual orientation..The authors make a comparative study of statutes, case law andhistory of the article 365, mainly the article 4 of the Juvenile Liability Act.
