摘要：O presente trabalho define água de lastro, bem como aborda a problemática e a poluição dela decorrentes em virtude de seu uso na rotina naval, apresentando uma visão internacionalista de análise da situação global. Apresenta os dispositivos a ela referentes, salientando o Tratado sobre Água de Lastro, sua importância e sua forma, a necessidade de sua ratificação em função da própria segurança marítima internacional e as dificuldades encontradas. Sugere novas interpretações do Tratado na esfera do Direito Internacional, visando a diminuir os requisitos formais e buscando a celeridade na implementação de uma nova norma de proteção ambiental, com o objetivo de inserir formas mais modernas e eficientes de tratamento desse problema ambiental, social e econômico.
其他摘要：This work defines ballast water and approaches the problems and especially the pollution arising as effect of its use in the routine of maritime commerce. It presents an internationalist, analytical of the global situation, and the written dispositions on this matter, especially the Agreement on Ballast Water, its importance and its form, the need of its ratification in function of the international marine safety and the difficulties found. It suggests new interpretations of the Agreement in the extent of the International Law in order to reduce the formal requirements and looking for the celerity to put into force a new pattern of environmental protection, with the objective of inserting more modern and efficient forms of treatment of this problems of so great environmental, social and economical significance.
