摘要：O presente estudo oferece resultados preliminares da atividade de pesquisa na linha de Direito Ambiental, vinculada ao Grupo Transdisciplinar em Pesquisa Jurídica para a Sustentabilidade (GTJUS) , cujo objetivo é destacar alguns aspectos da Lei Orgânica Municipal de Rio Grande (LOM/RG), no que tange a matéria ambiental, a partir do disposto no Capítulo IV, intitulado “Do Meio Ambiente”, inserido no Título IV – Da Defesa do Cidadão, Saúde e Meio Ambiente, considerando a perspectiva do chamado processo de globalização (ou globalizações) e seus efeitos na esfera local. Para tanto, a metodologia consistiu na coleta e análise de dados e documentos junto a arquivos de órgãos públicos, organizações não-governamentais (ONGs) e Internet, bem como revisão bibliográfica, tendo como objetivo a confrontação de dispositivos ambientais da LOM/RG com mandamentos constitucionais, considerando a produção legislativa ambiental local, a fim de tratar da compatibilidade legal e da sua eficácia. Junto às considerações finais, serão apresentadas recomendações.
其他摘要：This study presents preliminary results from research activities in the area of Environmental Law linked to the Transdisciplinary Group of Juridical Research for Sustainability (GTJUS). The goal is to highlight some aspects of the Organic Law of the Municipality of Rio Grande (LOM/RG) regarding environmental matters, as disposed of under the Chapter IV – “On the Environment”, inserted in the Title IV – “On the Defense of Citizen, Health and Environment”, in the perspective of the process of globalization and its effects on the local sphere. Data and documents obtained from public agencies, non-governmental organizations (NGO’s) and the internet were collected and analyzed, and a bibliographical revision was conducted, aiming to confront the environmental devices of the LOM/RG with constitutional commandments, considering the production of local environmental law, in order to evaluate the compatibility and effectiveness of the law. Concluding, the legal text of the LOM/RG is marked by juridical anthropocentrism and presents some deviations from the legislative technique. Furthermore, its efficacy is nullified by the absence of regulation.
