摘要：Este artigo objetiva refletir sobre a autonomia dos órgãos reguladores instituídos no âmbito estadual, destacando a importância de analisar os problemas regulatórios a partir de uma perspectiva multidisciplinar e argumentando que, para o funcionamento adequado do órgão regulador, é necessário fortalecer sua autonomia e independência, diminuindo o risco de captura. O artigo concentra-se na análise das medidas adotadas para manter e fortalecer a autonomia e independência do órgão regulador, destacando questões como forma jurídica das agências, estrutura organizacional, escolha dos dirigentes e autonomia financeira. No entanto, os casos recentes de duas agências reguladoras - a Asep, no estado do Rio de Janeiro, e a Agergs, no Rio Grande do Sul - demonstram as dificuldades de manter em prática a autonomia do órgão regulador.
其他摘要：This paper reflects on the autonomy of the regulatory authorities on the state level, stressing on the importance of analyzing the regulatory problems from a multidisciplinary perspective. It argues that, for the regulatory authority to work properly, it is necessary to strengthen its autonomy and independence, thus diminishing the risk of its being captured. The paper concentrates on the analysis of the measures adopted to maintain and strengthen the autonomy and independence of the regulatory authority, emphasizing issues such as the agencies' legal form, organizational structure, choice of directors, and financial independence. Nevertheless, the recent cases of two regulatory agencies - Asep, in the state of Rio de Janeiro, and Agergs, in Rio de Grande do Sul - show the difficulties or putting into practice the autonomy of the regulatory agency.
