摘要：O presente artigo apresenta as implicações da teoria de Jurgen Habermas nos Novos Direitos, sobretudo nas questões relativas à eugenia.Nesse contexto, trabalha-se a questão das interferências do dammbruchargumente na autocompreensão ética da espécie humana.Após, com base no futuro da natureza humana habermasiano, utiliza-se o Direito como meio de proibição da heterodeterminação externa irreversível.Ao final, são demonstradas as implicações do debate entre Ronald Dworkin e Jurgen Habermas, numa problematização da questão eugênica.
其他摘要：This article aims to present the implications of Jurgen Habermas theory in the New Rights, especially in matters related to eugenics. In this context, we work the issue of dammbruchargumente’s interferences on ethical self-understanding of the human species. Then, based on Habermasian human nature, we use the Law as a means of prohibiting the outer irreversible heterodetermination. In the end, it is demonstrated the implications between Ronald Dworkin and Jurgen Habermas debate about the eugenics matters.
