摘要：O presente artigo discute, primeiramente, a relação entre linguagem, comunicação e formação do conhecimento, revisitando o pensamento de Luhmann e de teóricos da linguagem, como Saussure.Ainda nesse sentido, o caráter autopoiético da comunicação é tomado em destaque.Na sequência, a comunicação no Direito e o seu caráter autopoiético são discutidos sob diversas perspectivas da Teoria do Direito, em especial da Teoria dos Sistemas de Luhmann.
其他摘要：This article discusses, initially, the relationship between language, communication and formation of knowledge, revisiting the thought of Luhmann and of thinkers of language, like Saussure. Also in this sense, the autopoietic nature of communication is highlighted. Then the communication in Law and its autopoietic character are discussed from innovative perspectives of the Theory of Law, in particular of Luhmann’s Systems Theory.
