摘要：Dados da Organização para a Cooperação e Desenvolvimento Econômico – OCDE – demonstram que o Brasil investe em educação um percentual do PIB menor que países desenvolvidos e até mesmo que outros países da América do Sul. O Estatuto da Criança e do Adolescente trouxe no Capítulo IV - Do Direito à Educação, à Cultura, ao Esporte e ao Lazer – a garantia do direito à educação, bem como os deveres do Estado, dos pais ou responsáveis e dos dirigentes dos estabelecimentos de ensino fundamental. Assim, este artigo objetiva discutir o direito à educação e o dever do Estado nesta seara, tudo sob o prisma da constitucional.
