摘要：Diante da determinação constante dos arts.18 e 31 da Lei de Arbitragem brasileira, no sentido de que o árbitro é juiz de fato e de direito da causa da qual for julgador, o presente trabalho questiona quais os limites de seu poder, em especial no que diz respeito à possibilidade de controle de constitucionalidade das leis no âmbito do procedimento arbitral. Após breve comentário sobre sistemas de controle de constitucionalidade no direito comparado, e do importante registro de que há ordenamentos em que o controle é atividade privativa de um órgão, enquanto em outros pode ser exercido por todas as instâncias judiciais, são analisadas diferentes hipóteses envolvendo o poder-dever de fiscalizar as leis em tribunais arbitrais. Aborda-se também a possibilidade de homologação pelo STJ de laudos proferidos no exterior em certas situações que envolvem conflito entre lei e Constituição. Articles 18 and 31 of the Arbitration Law of Brazil set forth that the arbitrator is the judge of fact and law in what concerns the case he or she is going to decide. Taking that into account, this paper analyzes what are the limits of his or her powers, in particular when it comes to the analysis of the constitutionality of the laws to be applied in the case under analysis. After a brief note on judicial review systems under comparative law and taking into consideration that in some systems this control is concentrated in one body, while in others it may be performed by all courts, different scenarios are analyzed, it is discussed the possibility of recognition of awards rendered abroad in situations that involve conflict between laws and the Constitution.
