摘要：I examine three articles dedicated by Gagarin to the status of women in the Code of Gortyn: the first article takes into account the terminology related to the management of the property with reference to women; in the second article he examines the laws whose subject is identified with a woman and in the third article, published in this same journal (“Dike” 15) he examines the formation of women’s property, the capacity to dispose of it, and the right to inherit from women. Gagarin argues that women were able to personally manage their assets. In my opinion acts of administration and disposal may be achieved only by the man who exercises control over the assets of a woman, although the “guardian” (kyrios) is never mentioned in the Code e in the other laws from Gortyn.Si esaminano tre articoli che Gagarin dedica alla condizione della donna nel Codice di Gortina: nel primo prende in considerazione la terminologia relativa all’acquisto e alla gestione della proprietà con riferimento alle donne; nel secondo esamina le leggi il cui soggetto è identificato con una donna; nel terzo prende in esame i “beni materni”, cioè la formazione del patrimonio femminile, la capacità di disporre di esso, la successione nei beni femminili. Gagarin sostiene che le donne erano capaci di amministrare e disporre personalmente del loro patrimonio. Io ritengo invece che amministrazione e atti di disposizione possano essere compiuti soltanto dall’uomo che esercita il controllo sul patrimonio della donna, nonostante il fatto che il tutore (kyrios) non sia mai menzionata esplicitamente nei testi di legge provenienti da Gortina.
