摘要:The procedural tradition supported by modern scientism project finds difficuties to compose the environmental problems of reputable way to its constitutive complexity. This study aims to analyze the social semantic crisis and its effects on the operability of the evidence in environmental law. To the epistemological rationalism can be attributed the inspiration of the methodological characteristics of modern science such as controllability, causality, determinism and axiomatization. This conception of science will settle the foundations of modern legal theory, being therefore essential its description to understand the structure of evidential theory in the law and its (in)ablitity to embrace the demands of complex society, such as environmental disputes.
