摘要：Durante estos últimos años la crisis económica ha provocado el continuo e imparable devenir de miles de ejecuciones hipotecarias. Un drama social para muchas familias. Ante este dantesco escenario, mientras la sociedad clamaba justicia, el legislador miraba hacia un lado, con una actitud impasible, atado de manos, ante la necesidad de preservar la seguridad jurídica del sistema hipotecario, así como la fuerza vinculante de los contratos. No obstante, finalmente el legislador se percató de esta situación, publicando una serie de normas que, lejos de caer en el olvido, serán la huella de una legislación de crisis excepcional en la historia del Derecho español, por la ruptura de ciertos dogmas jurídicos y por el resurgir legal del espíritu que define la cláusula rebus sic stantibus.
其他摘要：For the past couple of years the economic recession has led to an unstoppable, constant progression of thousands of mortgage executions. This creates a social drama for many families. While society was claiming for justice, legislators were not paying much attention to such a dantesque scene, in a pitiless mood, without being able to do much as they faced the need to preserve the legal certainty of the mortgage system together with the contracts binding force. Nevertheless, legislators finally realized this situation disclosing a series of laws which, far from being easily forgotten will become the basis of a recession law somehow unusual in the history of Spanish law, due to the break of certain legal statements and to the legal comeback of the spirit behind the rebus sic stantibus term.
