摘要：As normas jurídicas não alcançam ao julgador a discricionariedade vista historicamente nos pretórios. No mais das vezes, a aplicação das teorias da decisão presentes na modernidade acaba por justificar os julgamentos conforme a própria consciência. Regras e princípios são normas, registrando mera distinção ontológica. A teoria de Alexy, nesse sentido, parece sofisticar a decisão, erigindo as antinomias jurídicas impróprias à categoria primeira de sua teoria da decisão, mesmo quando a aplicação singela da norma viabiliza a solução para o caso. É exatamente o alcance da teoria alexyana que se procura dimensionar.
其他摘要：The legal rules do not reach to the judge the discretion that had been seen in court. Most of the cases show that the application of the decision theories present in modernity justify the judgments according to their conscience. Rules and principles are standards, registering simple ontological distinction. Alexy’s theory seems to make the decision more sophisticated, raising legal antinomies above the first category of his decision theory, even when the simple application of the standard enables the solution to the case.
