摘要：O presente artigo tem como principal objetivo o estudo da educação como direito fundamental, sobretudo do direito de acesso aos níveis mais elevados da educação.Ressalta-se que a justificativa para esse enfoque se dá em razão do destaque sobre o direito à educação, notadamente no que tange aos preceitos traçados pela Constituição da República de 1988.Essa abordagem contribui para uma análise crítica sobre a efetividade das normas constitucionais que dispõe sobre o acesso ao ensino superior e para a elaboração de propostas de intervenções futuras, que visem à melhoria da educação no país.Para isso, foram analisados alguns aspectos sobre a educação no Brasil (programas e ações afirmativas).Adotou-se o tema por ser um assunto de discussão recente e de grande contribuição para o universo acadêmico.Ao final, conclui-se que as ações afirmativas, como o PROUNI, contribuem para o cumprimento das disposições constitucionais, permitindo um mínimo de efetividade do direito fundamental à educação superior.Contudo, as universidades privadas passam por crises que podem afetar a educação e, consequentemente, o próprio direito.
其他摘要：The present article has as main objective the study of education as a fundamental right,
especially the right of access to higher education. The reason for this focus is due to the
emphasis on the right to education, especially in regard to the precepts set by the Constitution of 1988. This approach contributes to a critical analysis of the effectiveness of constitutional
rules that provides for access to higher education, for the development of proposals for future
interventions, aimed at improving education in the country. To this, were analyzed some
aspects of education in Brazil (programs and affirmative actions). This theme was adopted for
be a subject of recent discussion and great contribution to the academic world. At the end, it is
concluded that affirmative actions as PROUNI contribute to the fulfillment of constitutional
provisions, allowing a minimum of effectiveness of the fundamental right to higher education.
However, private universities go through crises that can affect education and, consequently,
the right itself.
