摘要：Resumo: Trata o presente trabalho da atuação do Poder Judiciário no que concerne à deliberação das políticas públicas, com ênfase à análise da política de dispensação de medicamentos excepcionais estabelecida pelo Sistema Único de Saúde (SUS), a partir da análise de caso concreto que envolve o fornecimento de um medicamento – não contemplado pela Política Farmacêutica da Rede Pública - para o tratamento de duas crianças com enfermidades raras. Para tanto, analisar-se-á, primeiramente, aspectos da teoria Dworkiana presentes na decisão judicial do caso, para então discutir se há deferimento de uma possível interferência ilegítima do Judiciário no Sistema Político, utilizando-se, posteriormente, de categorias analíticas da teoria de Luhmann. Abstract: Treats the Judiciary current performance on what concerns the public policies deliberation, emphasizing the analysis of the policy of dispensation of exceptional medicaments, established by the Sistema Único de Saúde (SUS), out of the analysis of a concrete case that involves the supplying of medicines – non contemplated by the Pharmaceutical Public Policy - for the treatment of two children with rare diseases. Therefore, shall be analyzed, first of all, aspects of the Dworkin’s Theory present in the judicial decision of the case, and then be discussed if there is the grant of a possible illegitimate interference of the Judiciary on the Political System, making use later of the analytical categories of Luhmann’s Theory.
