摘要：Há duas teorias na filosofia hegeliana que justificam a punição: a via da expiação e a via da cura.A via da expiação parte do agente da punição e afirma que a responsabilidade do crime é do criminoso.Essa via ocupa-se essencialmente com o dever e as regras.Hegel difere da posição retributivista kantiana, pois, segundo Kant, a pena é uma necessidade ética (imperativo categórico) e para Hegel, a pena é uma necessidade lógica (negação do crime e afirmação da pena).Kant permanece preso à subjetividade; Hegel supera-o através de uma explicação objetiva do direito penal.Já a via da cura parte do paciente da punição e defende que a punição é um direito do criminoso.Assim, o dever é secundário e o castigo é visto como gerador do sofrimento.
其他摘要：There are two theories on hegelian philosophy to justify the punishment: the way of atonement and the way of healing. The route of the atonement of the agent of punishment and states that the responsibility for the crime is the criminal. This pathway is concerned essentially with the duty and the rules. Hegel differs from kantian retributivista position because, according to Kant, the penalty is an ethical necessity (categorical imperative) and Hegel, the penalty is a logical necessity (denial of crime and affirmation of the sentence). Kant remains attached to the subjectivity; Hegel overcomes it through an objective explanation of criminal law. Have the path of healing part of the punishment and patient advocates that the punishment is a right of the criminal. Thus, the duty is secondary and the punishment is seen as suffering from the generator.
