摘要：En este trabajo se analizan los tres primeros párrafos del artículo 36 del Real Decreto-ley 11/2020, en los que se regula la patología que la situación de pandemia provocada por el coronavirus causa sobre los contratos de compraventa y de servicios celebrados por consumidores y que tienen como principal objetivo la protección de estos. Se toma como referencia para la regulación de esta cuestión la doctrina vertida en torno a la cláusula rebus sic stantibus lo que provoca importantes disfunciones. Por un lado, el supuesto de hecho no está bien perfilado y suscita numerosos interrogantes y, por otro lado, como remedio se otorga al consumidor una facultad resolutoria con un plazo de prescripción de 14 días y que solo es efectiva si, pasados 60 días, las partes no han conseguido reconfigurar el contenido del contrato. Para valorar adecuadamente esta regulación dictada para unas circunstancias extraordinarias se procede a comparar con la que resultaría de aplicación en tiempo ordinario.
其他摘要：In this work are analyzed the first three paragraphs of article 36 of Royal Decree- Law 11/2020, which regulates the pathology that the pandemic situation caused by the coronavirus causes on the contracts of sale and services concluded by consumers having as the main objective the protection of these. The doctrine based on the rebus sic stantibus clause is taken as a reference for regulation, which causes important dysfunctions. On the one hand, the factual assumption is not well outlined and raises numerous questions and, on the other hand, as a remedy, the consumer is granted a power to terminate the contract within a period of 14 days and that is only effective if, after 60 days, the parties have not succeeded in reconfiguring the content of the contract. To properly assess this regulation issued for extraordinary circumstances, we proceed to compare it with the regulation that would be applicable in ordinary time.
