摘要:The policy to abolish customary court juridically recognizes state courts as the only judicial system in Indonesia. However, in practice, the customary dispute resolution institutions in West Sumatra still exist. This article will examine the practices of customary dispute solving in West Sumatra. This article uses a sociological juridical approach, and it looks at the rules, concepts, views of society, and legal doctrines. The study results show that customary dispute solving involves some stages that are carried out by the principle of 'bajanjang naiak batanggo turun'. The process consists of the Bakaum stage (consultation between people), the Bakampuang stage (settlement in each village), the Pasukuan stage (settlement assisted by other tribes) and Babalai Bamusajik. Unless the dispute is solved, the People will submit the dispute to 'Lembaga Kerapatan Nagari'.
