摘要:Leaking bank secrecy harms the privacy rights and electronic personal data of customers. Therefore this study discusses the issue of customer protection against leakage of bank secrets as a violation of the privacy rights and electronic personal data of bank customers and the responsibilities of other parties, directors and bank employees. The study results show that the protection of customers and leakage of bank secrecy is not explicitly stated in the Banking Law. However, based on a grammatical and systematic interpretation, it violates the privacy rights and electronic personal data of bank customers. Therefore, this study comes with a few conclusions: The liability of other parties who force banks to divulge bank secrets is the liability based on the fault principle; the liability of the bank directors for their actions in divulging bank secrets is based on strict liability and or vicarious liability if the perpetrator is a party under their supervision; and the responsibilities of bank employees through the principle of presumption of liability.
