摘要:Sexual Harassment at workplace is a pervasive issue prevailing in our society. It is the forceful imposition of oneself over the other. The paper highlights that there is a dire necessity for gender neutral sexual harassment laws in India. The statute on workplace sexual harassment being gender specific belies the presumption that only a woman can be a victim of this offence. Sexual Harassment violates modesty and dignity of an individual. The term modesty is not synonymous with women only; every person including men and trans genders possess the same. A crime is a crime; the moment the perpetrator or the victim of the offence is coloured by gender or sexual orientation, it defeats the purpose of the justice and law in totality. Right of life under article 21 of Indian Constitution includes right to harassment and discrimination free environment. Dignified workplace is a basic right of every individual. The paper also focusses on the issue of need for gender sensitization and recognition to same gender harassment. The quest is not in regards with man v. woman, instead it’s for gender neutrality and gender justice. Gender neutral laws will help in prevention of sexual harassment and will protect all individuals irrespective of gender.
