摘要：The issue of child labor is one of the problems that requires special handling from the government. Basically the issue of child labor is not limited to the problem of children getting wages but more than that. Child labor is related to the obstruction of access to education, exploitation, and even being able to affect the social, physical and psychological development of children. Most of the child laborers are employed in businesses operating in the informal sector. Child workers selling kipang snacks in Medan City, tend to sell almost all day or in other words until they sell out. This child laborer is also not bound by an employment agreement in his employment relationship. So it can be said that the child workers selling kipang in Medan City are close to the word exploitation. This study aims to analyze the legal protection of child laborers selling Kipang snacks in the city of Medan, whether it is in accordance with the rights of child workers based on Law no. 13 of 2003 concerning Manpower. Typology of empirical juridical research, so that secondary data will be accompanied by primary data directly obtained from observations in the field through interviews and distributing questionnaires. Data were analyzed qualitatively. The results showed that there were 2 types of child workers selling kipang snacks. Children who work for other parties as business actors and children who work outside the employment relationship. For children who work with other parties, the provisions of Article 69 of the Manpower Law apply, while for children who work outside of an employment relationship, it is based on the provisions of Article 75 of the Manpower Law that the Government is obliged to take measures to overcome children who work outside of an employment relationship. These efforts must be carried out in a planned, integrated, and coordinated manner with the relevant agencies. Furthermore, the said countermeasures are regulated in a government regulation.
