摘要：O artigo versa de forma crítica sobre a desproporcionalidade da pena mínima cominada ao crime de estupro, previsto no art. 213 do Código Penal Brasileiro, quando aplicado a condutas que causam menor lesão ao bem jurídico da vítima. A temática abrange a necessidade da criação de um tipo penal intermediário que supra a lacuna legal existente e seja viável para punir as condutas menos gravosas, sem que isso viole os princípios fundamentais inerentes tanto ao autor quanto à vítima do crime. Expõem-se, para tanto, os contornos conceituais, a análise do bem jurídico protegido e da figura típica abarcada pelo delito, os princípios aplicáveis à espécie, os motivos que tornam insuficiente a norma penal existente, bem como a aplicação prática das alternativas jurisprudenciais criadas para diminuir a desproporção.
其他摘要：The article critically talks about the disproportionality of the minimum penalty on the crime of rape, which is in the art. 213 of the Brazilian Penal Code, when this applied to conduct that cause less damage to the well of the victim. The theme includes the need of creating a criminal type that fill the legal gap and be feasible to penalize the less serious conduct, without this violates the fundamental principles inherent to both, the author and the victim of the crime. This study exposes, thus, conceptual boundaries, it analyzes the protected legal well and the typical figure covered by this crime, the principles applicable to the species, the reasons that make insufficient the existing criminal law, as well as the practical application of legal alternatives designed to reduce the disproportion.
