摘要：Osmanlý Devletinde Vakýf geleneði önemli yer teþkil etmektedir. Osmanlý'da devlet, vatandaþýn canýný, malýný korumak, asayiþi saðlamak, sýnýrlarý muhafaza etmek, devlet düzenini ne bahasýna olursa olsun her þeyden üstün tutmak, bu düzeni ilgilendiren her türlü yüksek menfaati saðlamakla mükelleftir. Buna karþýn bayýndýrlýk eseri yaptýrmakla, vatandaþý okutmakla, onun ibadetine yarayan yapýlar inþa etmekle ve bu gibi þeylerle mükellef deðildi. Vakýflarýn, uluslararasý hukuk tarafýndan kabul görmesi, bugün için bu önemini daha da arttýrmaktadýr. Malum olduðu üzere araþtýrma konumuz olan Kýbrýs adasýnda 1878 tarihinde baþlayan Ýngiliz koloni hâkimiyeti pek çok soruna yol açmýþtýr. O günlerde acil olarak deðiþtirilmesi gereken ve bizim bugün önemle üzerinde durmamýz gereken vakýf konusu önemle irdelenmelidir. Özellikle her iki toplum arasýnda devam eden ve mahkemelere intikal eden davalarda, vakýf kayýtlarý, Türk tarafýnýn tezini kuvvetlendirecek hüviyettedir. Bu makale, Kýbrýs'ta vakýf sorununu ifade etmek maksadýyla hazýrlanýlmaya çalýþýlmýþtýr. Kýbrýs'ta, özellikle binin üzerinde vakýf olduðu gerçeði ortadayken, bu konudaki çalýþmalarý önemi anlamak hiç de zor olmasa gerektir.
其他摘要：Within the Ottoman Empire, the tradition of Foundation used to constitute a major position. The Empire was obliged to protect the citizens lives and properties, keep the peace, take care of the borders prefer the order of the state to everything at all costs and to provide the great profits about the order. On the other hand, it was not obliged to do public works such as educating the citizens, constructing sanctuaries, and so. The fact that foundations are accepted by the International Law increases their importance for today. As we know, the British Colonial Hegemony caused several problems in the island of Cyprus, which is our research subject. The subject of foundations which had to be changed urgently then and on which we should dwell must be scrutinized carefully. Particularly, the records of foundations have got the features which strengthen the Turkish thesis at the ongoing and new opened lawsuits in the courts. This article has been prepared to state the foundation question in Cyprus. While the fact that especially there were more than a thousand foundations is evident, it is not difficult to understand the importance of the studies on this subject.
