摘要:The reform of liberal profession is, to a large extent, convoluted due to the difficulty to separate the strictly necessary rules from those unnecessary or even damaging for consumers and for the profession itself. Studies performed at the European Commission’s request have highlighted the existence of important differences as regards the level of regulation existing in various Member States and between various liberal professions. The European Union considers that the best way to perform the modernization and the reform in this field should be the voluntary action of the stakeholders; the regulatory authorities and professional authorities with self-regulating role should reassess the existing legal framework and define the sphere of the rules that are strictly necessary for the achievement of a public interest objective. The European Council from March 2005 underlined the importance of competition advocacy in all fields, including in the area of liberal professions; the Member States were requested to review national legislation with a view to ensure its compatibility with the Community rules on removal of barriers and on opening-up the internal market to competition.
