摘要：The cartel and the abuse of a dominant position are competition restrictive practices which have a harmful effect on the competition, therefore these practices are carefully monitored at the level of European Union. The paper aims to analyse the legislation in force, the measures that can be taken when such behaviours are discovered and to analyze the way in which the competition authorities have managed to implement the competition policy. The research methodology used is the analysis of the legislation regulating the anticompetitive practices, the study of the literature in the field, the gathering and interpretation of the statistical data of the 2011-2013 period and the case study. The paper intends to emphasize the preoccupation of the European Commission with the competition policy and the role the national competition authorities have within the EU member states in implementing these policies.
