摘要：Asumiendo que las cuestiones querodean el debate sobre la teoría de lajusticia de Rawls no tienen por objetodiscutir el problema del sistema jurídico,principalmente porque el autor no se hadedicado a abordar tal cuestión, se busca,en este trabajo, discutir el concepto y loscalificadores del sistema jurídico.El textose divide en cuatro partes: la primera estádestinada a la problematización del de-recho y de las instituciones legales comoparte de las instituciones de la estructurabásica de la justicia como equidad; la segunda de ellas tiene la intención de darsecuenta de lo que es una institución, desu constitución por reglas y normas decarácter público, destinadas a personasracionales y de la propia concepción dereglas; en la tercera parte se pretendeacercar el sistema legal y sus componen-tes a la tensión entre la justicia formaly justicia substancial; por último, en lacuarta parte, se discuten los principiosque componen el ideal del Estado dederecho, que es la transformación de laaplicación de la justicia formal al sistemajurídico, teniendo en cuenta apuntara la perspectiva de que los derechosindividuales, especialmente la prioridadde la libertad, son objeto principal de suprotección.
其他摘要：Assuming that the issues regardingthe debate on Rawls’ theory of justiceare not aimed at discussing the problemof the legal system, mainly because theauthor has not approached such mat-ter, this work discusses the concept andthe qualifiers of the legal system.Thetext is divided in four sections: the firstsection is about the problematizationof law and legal entities as part of theinstitutions of the basic structure ofjustice as fairness The second section isabout realising what an institution is, of how its constitution is based on publicrules and regulations made for rationalpeople and regarding the very concep-tion of the rules. The third section isabout considering the legal system andits components to handle the tensionbetween the formal justice and the sub-stantial justice. Finally, the fourth sectiondiscusses the principles that make up theideal of rule of law, which changes howformal justice applies to the legal system,which considers that individual rights,especially the priority of liberty, are itsmain object of protection.
