摘要：Elartículo analiza el proceso de movilizaciónlegal respecto de la política de subsidioshabitacionales del Gobierno de la Cuidad deBuenos Aires. Lejos de representar casos delitigio estructural orientados a modificar lapolítica pública, que son aquellos que captanla atención del mundo académico, este trabajoilumina sobre un conjunto de casos decarácter individual, recurrente, rutinario ymasivo que ocupan una gran parte deltiempo y de los recursos de las burocraciasjudiciales y del poder ejecutivo. Durantemás de una década de litigio se establecieroncircuitos políticos institucionales y prácticasadaptativas entre ambos poderes. Por unlado, la justicia local es accesible a lasdemandas individuales ofreciendo evidenciadel acceso a los tribunales por parte de lapoblación de bajos recursos; por otro lado,en sus interacciones con el poder ejecutivo,la justicia se consolida como “la otraventanilla” al facilitar la continuidad de lossubsidios habitacionales para esos sectoressin efectuar revisiones de la política quemejoren la calidad de vida de la poblacióndemandante de manera sustancial.
其他摘要：This article analyzes the process of legalmobilization regarding the policy of housingsubsidies by the Buenos Aires CityGovernment. Far from representing cases ofstructural dispute seeking to modify thepublic policy –cases that usually catch theattention of the academic environment–, thispaper sheds light on a number of individual,recurrent, massive and routine cases thatdemand a large amount of time and resourcesfrom the judicial bureaucracies and from theexecutive branch. Over more than a decadeof dispute, there were established institutionalpolitical circuits and adaptative practicesbetween the judicial and executive power.On the one hand, local justice is accessiblefor individual demands by offering a clearopening on the access to courts for the citizenswith low income. On the other hand, byinteracting with the executive branch, localjustice consolidates itself as a “new-stopwindow” by providing easy access to thecontinuity of housing subsidies for that socialgroups without revising the policy that mightenhance substantially the demandingpopulation’s quality life.
