摘要：El artículo analiza los elementos esenciales del derecho a la educación en el Derecho Chileno, situando al educando en el centro de todo el proceso educacional. De este modo, se estudia el derecho y el deber de los padres a educar a sus hijos, eligiendo el establecimiento educacional que estimen conveniente para el mejor desarrollo de sus habilidades. Asimismo, se analiza el deber del Estado de diseñar un régimen gratuito para la educación obligatoria, con la finalidad de permitir el acceso a los niveles educativos obligatorios de toda la población.
其他摘要：The article discusses the essential elements of the right to education in the Chilean law, placing the learner the center of the whole educational process. Thus, the right and duty of parents to educate their children, choosing the educational institution of their own choosing for the best development of your skills is studied. Also, the State’s duty to design a scheme for compulsory free education, in order to allow access to compulsory education levels of the population is analyzed.
