摘要：El artículo realiza un análisis de la sentencia de la Corte Interamericana de Derechos Humanos en el caso Familia Pacheco Tineo vs. Estado Plurinacional de Bolivia. Se señalan tres aspectos. Primero, la aplicación de los criterios establecidos en decisiones previas sobre las garantías en caso de expulsión de extranjeros y su relación con el principio de no devolución. Segundo, la consideración que hace la Corte (por primera vez) sobre el derecho a buscar y recibir asilo reconocido convencionalmente. Tercero, la atención que se presta a la especial protección de la que es merecedora la niñez migrante, tanto en relación con la expulsión del territorio del Estado como en relación con el derecho al asilo, en vistas a la protección de su interés superior. El artículo ubica la sentencia en el contexto de los precedentes interamericanos (de la propia Corte y de la Comisión) sobre los temas involucrados y pone de manifiesto sus aportes novedosos.
其他摘要：The article analyzes the judgment of the Inter- American Court of Human Rights in the Familia Pacheco Tineo vs. Plurinational State of Bolivia case. Three aspects are considered. First, the application of the criteria set out in former decisions on guarantees in case of expulsion of foreigners and their relationship with the principle of non-refoulement. Second, the consideration of the Court (for the first time) on the right to seek and receive asylum recognized in the American Convention. Third, the attention put into the special protection that migrant children receive, both in relation to the expulsion from the territory of the State and the right to asylum, in view of the protection of their best interest. The article places the judgement in the context of the Inter-American Court and Commission precedents, on the issues involved and reveals its innovative contributions.
