摘要：Según los sistemas latinos el engaño en el delito de estafa requiere cierta entidad para ser típico. Esta calidad puede determinarse según un criterio objetivo-subjetivo, conforme a los filtros de la teoría de la imputación objetiva, y de acuerdo con la teoría de la estafa como infracción de un deber de veracidad. Cualquiera de estos modelos es aplicable en Chile, y este trabajo quiere demostrar que el sistema más adecuado es el de la imputación objetiva del resultado.
其他摘要：According to Latin legal systems the deceit required to found "fraud" requires a certain organization to be part of the act. This quality can be determined according to an objective-subjective criterion as filtered through the theory of objective imputation. and according to the theory of fraud as a violation of the obligation to be truthful. Any of these models is applicable in Chile, and this work seeks to demonstrate that the most appropriate approach is that of objective imputation of the result.
