摘要:Price reduction as a remedy is found in many international instruments and in the legal tradition of diversecountries. For example, it has been regulated in the German Civil Code*1 (BGB), the Dutch Civil Code*2(BW), and the Estonian Law of Obligations Act*3 (LOA). *4 In addition, price reduction belongs to the systemof remedies acknowledged in international and EU legislation and model regulations. For instance,price reduction is provided for as a remedy in Directive 1999/44/EC of the European Parliament and of theCouncil on certain aspects of the sale of consumer goods and associated guarantees*5 (i.e., the ConsumerSales Directive), United Nations Convention on Contracts for the International Sale of Goods*6 (CISG), Proposalfor a Regulation of the European Parliament and of the Council on a Common European Sales Law*7(CESL), and Draft Common Frame of Reference *8 (DCFR).
