- 摘要：
متون ادبی مجموعه‌ای از ذخایر فکری و فرهنگی ملتها و بازتاب اندیشه‌ها و عقاید و آمال آنهاست که در هر عصر و دوره‌ای متأثّر از جامعه و مردم و نیازهای آنان است. مسائل بسیاری همچون جامعه‌شناسی، مدیریت، اقتصاد، سیاست، نمودهای فرهنگی و اجتماعی و حقوق در ادبیات نهفته است؛ بنابراین در شناخت ملّت‌ها ناگزیر از آشنایی با ادبیات آنها هستیم. مباحث حقوقی و مفاهیم و اصطلاحات وابسته به آن از جمله مسائلی است که در این متون برجستگی خاصی دارد و تاکنون کمتر به آن توجه شده است. در این مقاله تلاش نگارندگان آنست که باب شیر و گاو و با بازجست کار دمنه را به لحاظ حقوق کیفری که خود یکی از شاخه‌های اصلی علم حقوق است، بررسی کنند؛ زیرا پدیده جرم و مجرم در این دو باب پررنگ تر جلوه‌گر شده است. جرم و مجرم، انواع مجازات و اهداف آن و مباحث مربوط به عدالت کیفری همچون شهادت، تحقیقات قضایی و تأثیرپذیری قاضی در این مقاله مطرح شده است. در هر مورد سعی بر آنست که مباحث طرح شده در مقایسه با حقوق جزای اسلامی مورد تجزیه و تحلیل قرار گیرد. این تحقیق مبین آنست که با تأمّل و توغّل در متون ادبی می توان به نقطه تلاقی در ادبیات و مباحث حقوقی دست یافت تا در نتیجه ادبیات و محتوای پربار و ارزشمند آن در جهت غنای قوانین و مقرّرات حقوقی و به عنوان عاملی مؤثّر در پیشگیری از جرایم و اصلاح فرد و سلامت جامعه به کار رود.
- 其他摘要：Literary texts are a set of intellectual and cultural reserves of nations and reflect their thoughts, ideas and hopes which in every era and period are affected by people and their needs. Many problems such as sociology, management, economy, politics, cultural and social aspects and law exist in literature. Thus, in order to know nations one has to be affiliated with their literature. Legal subjects and related concepts and terms are among issues which are specifically prominent in these texts and so far little attention has been paid to them. In this research authors try to examine the chapters of "Lion and Cow" and "investigating Demne's work" in terms of criminal law, which alone is one of the principal branches of law, because the phenomena of crime and criminal are highly manifested in these two chapters. Crime and criminal, various punishments and their objectives, and subjects related to penal justice such as testimony, juridical investigations and judge's impressionability are posed in this paper and in each case it is tried to analyze the subjects in comparison to Islamic criminal law. This research indicates that by thinking and going through literary texts one can find the point of similarity between literature and legal discussions. As a result, literature and its valuable content can be used for enriching legal rules and regulations as well as preventing crimes and promoting health of society
