The Differences in the Approach to Forming a Contract Generally, the Japanese approach to contract formation differs significantly from the American approach. Indeed, without this difference many disputes between the countries would not exist. Nevertheless, presently, the typical American business person says the Japanese approach to business negotiations wastes time.
