摘要：En el presente trabajo se reflexiona sobre los conocimientos básicos que se deben proporcionar al ingeniero cuando la invención se desarrolla dentro de una Universidad, en este caso y por la vinculación y docencia impartida, lo vamos a ubicar en la Universitat Politècnica de València, teniendo en cuenta la normative específica al respecto, además de la legislación general aplicable, con la finalidad de establecer el marco legal y solventar algunas dudas que se plantean por parte del ingeniero cuando obtiene un resultado protegido por la propiedad industrial dentro del ámbito universitario. La metodología utilizada se centra en el análisis de la normativa aplicable, con las recientes modificaciones en materia de patentes, así como en los principales problemas que suscita la propiedad industrial en el ámbito de la investigación en un centro universitario. Los resultados indican que la normativa regula de forma correcta la invención, y que el investigador, en algunas ocasiones, desconoce los principales aspectos normativos que le son aplicables, por lo que es preciso realizar una formación adecuada para evitar situaciones que puedan afectar a la investigación realizada.
其他摘要：In this article the author analyses the basic knowledge that must provide the Engineer when the invention develops inside a University. In this case and for the entail and given teaching, we are going to locate it in València’s Universitat Politècnica, taking into account the specific regulations in the matter, besides the general applicable legislation, with the purpose of establishing the legal frame and resolve some doubts that the Engineer could face when obtaining a result protected by the industrial property inside the university area. The methodology is centered on the analysis of the applicable regulation, with the recent modifications for patents, as well as the principal problems that the industrial property provokes in the area of the investigation in a university center. The results indicate that the law regulates the invention properly and the researcher, sometimes, doesn’t know the main regulatory issues that apply to it, so it must make adequate training to avoid situations that might affect the investigation.
