摘要：The freedom in the modern state is backed by law , the fulfillment of what is provided by law is that it provides direct security to citizens and gives confidence to the States . The institution of the national constitution is central in this discussion , given that this is the law made to last , functioning as a mechanism of checks and balances . This article addresses this issue through a theoretical and empirical flyby , bringing to discuss issues and concepts fundamental to the understanding of contemporary democratic theory .
