摘要:The article aims to present the results of a mapping of the judicial decisions on the right to education of the São Paulo Court of Justice, from 1998 to 2013. This paper shows the type of action (individual or collective) which was proposed, the author of the action and analyzes the justifications of the judicial decisions. Moreover, it shows their influence on the public policy related to the creation of slots in the early childhood education, primary education and secondary education in São Paulo State. Subsequently, we compare the results with those obtained in the researches on the judicial decisions concerning the right to health. We conclude that there was an institutional change of the São Paulo Court of Justice decisions, with its greater receptivity in the judgment of the collective action referring to the right to education.
