摘要：Muitos foram os desafios enfrentados pelo ambiente até alcançar a relevância jurídico-social que tem atualmente. Nesse longo e tortuoso percurso, o ambiente já fora guarnecido por leis que visavam à proteção da propriedade privada, por outras sem qualquer preocupação com a degradação ambiental em si e, até mesmo, pelas que miravam à gestão dos recursos naturais, cujos fins eram meramente administrativos. Atualmente, a tutela-jurídica do ambiente alçou maior autonomia, inclusive na área penal, frente a seu reconhecimento constitucional como bem indispensável às presentes e futuras gerações. Diante disso, é preciso buscar conhecer efetivamente o cerne da proteção do ambiente pelo Direito Penal e a via pela qual se pretende desvendar isso neste trabalho é a ontognoseologia.
其他摘要：There were many challenges facing the environment to achieve legal and social relevance that currently have. In this long and tortuous route, the environment had been garrisoned by laws aimed at the protection of private property, other without any concern for environmental degradation itself and even by that took aim at management of natural resources, whose aims were merely administrative. Currently, the protection and legal environment lifted greater autonomy, including in the penalty area in front of their constitutional recognition as well essential for present and future generations. Therefore, it is necessary to look effectively meet the core of environmental protection by the criminal law and the way in which you want to unravel that this work is the ontognoseologia.
