摘要:The modern physician-patient-relationship is ideally characterized by shared decision making and active involvement of the patient into the decision making process concerning medical procedures. The patient shall decide in accordance to his will, both during a current treatment as well as in advance for the case that an illness renders him incapable to form or declare a free will. The latter is often done in the form of an advanced healthcare directive. This earlier recorded autonomous declaration of the patient's will pertains binding to both, the patient's relatives as well as caregivers. A particular conflicting situation arises in the case of an actual expression of a natural will (for example, as part of dementia), which precludes earlier made autonomous decisions. The purpose of this work is to show the principal possibility of free will formation and declaration by briefly recapitulating the discourse about determinism and free will and also to outline the different constructs of free will. Subsequently, the case of an actual natural will expression is examined under these aspects to provide an opportunity to (partially) exercise self-determination. Moreover, the possibility of trading off the actual natural will declaration against an earlier autonomous will declaration shall be discussed
