摘要:The principle of “civilian immunity” is the basic tenet of the code knownas jus in bello, or “justness in war.” This code, which instructs soldiersabout right and wrong in war, prohibits the infliction of intentionalharm on civilians and civil society in wartime, even in circumstances inwhich directly harming them could prove significantly advantageousfrom the military point of view. As is well known, in asymmetric warsof independence, this principle becomes especially problematic becausesuch wars involve parties with large and clear military disparities, wherethe weaker party’s combatants blend in the civilian population. In suchwars, there is no frontline and there are no uniforms.
