摘要:The Leveson Report on the British press, publishedafter the phone-hacking scandal that culminated inthe closure of News of the World and the detention ofdozens of journalists, recommends the inclusion of aconscience clause in journalists’ contracts to protectthem if they refuse to obey unethical orders. Spain wasthe first country in Europe to include journalists’ rightto a conscience clause in the Constitution of 1978 andto develop it by an organic law in 1997. However, morethan thirty years since its constitutional recognition, thebalance to be made is negative. Spanish journalists feelunder growing pressures coming from within their owncompanies, while the conscience clause is not perceivedas an actual and effective remedy. In this article weexplore some causes for the limited effectiveness of thejournalists’ conscience clause in Spain.
