DOI: 10.12957/rdc.2015.20905 Resumo Com o desenvolvimento das grandes cidades ao longo do século XX, assistimos a um adensamento populacional sem precedentes nestas regiões trazendo como consequência um transbordamento, em termos econômicos e de população, para municípios vizinhos, que passaram a orbitar estas grandes cidades com elevado grau de dependência econômica e com o compartilhamento dos problemas urbanos das grandes cidades sem a mesma capacidade econômica e política para fazer frente a eles. Nesse arranjo fático metropolitano, à luz dos preceitos constitucionais, surge a necessidade de uma formalização que garanta a justa distribuição dos ônus urbanos, dada a diferença de capacidade entre os entes e a promoção dos direitos ligados à cidade de forma conjunta, visto a inegável interdependência oriunda do arranjo metropolitano. O presente artigo visa exatamente a elucidar o papel das regiões metropolitanas na garantia destes direitos constitucionalmente garantidos. Palavras Chave: Regiões Metropolitanas; Direito à Cidade; Metrópoles Abstract Due to the development of great cities during the 20th century, we have experienced an unprecedented population densification in such regions, introducing, as a consequence, a population and economic overflow of neighboring municipalities. These municipalities have, ever since, orbited these great cities with an elevated level of economic dependence, as well as sharing the same urban issues of great cities areas, though not with the same economic and political capabilities to address them. In this factual metropolitan arrangement, in light of constitutional provisions, there is a need for a formalization able to ensure a fair distribution of urban onuses, given the difference of capabilities among governmental entities and the joint promotion of rights connected with cities, and also in view of the undeniable interdependence arising from the metropolitan arrangement. This paper aims at clarifying the role of metropolitan regions in the assurance of these constitutionally protected rights. Keywords: Metropolitan Arrangement; Right to the City; Great Cities
