摘要：A autonomia da vontade pode ser considerada um dos elementos do contrato, mas, nem sempre, foi vista como condição necessária para sua existência e nem seu elemento central. O contrato administrativo, precedido de um procedimento prévio de escolha do contratante particular, possui características próprias que o diferencia dos demais contratos típicos de direito privado. A liberdade de contratar para a administração pública não é plena, e existe nos limites da motivação do ato, declarando a finalidade última do Estado: o interesse público previsto em lei. A supremacia do interesse público e a busca da vontade coletiva mitigam a autonomia da vontade para a administração, evitando o arbítrio. The autonomy of the will can be considered as an element of the contract, but not always, been seen as a necessary condition for their existence and not its central element. The administrative contract, preceded by a previous procedure of choosing a particular contractor, has its own characteristics that differentiate them from other contracts typical of Private Law. The freedom to contract for Public Administration is not full, and there on the edge of the motivation of the act, declaring that the ultimate purpose of the state: the public interest provided by law. The supremacy of public interest and the pursuit of collective will mitigate the freedom of choice for the Administration, avoiding arbitration.
