摘要：Uno de los grandes cambios durante el proceso de transformación en el modelo de desarrollo de la agricultura en México iniciado en los años ochenta fue la adopción del régimen de propiedad industrial en variedades vegetales. En virtud de un compromiso adquirido por México en el Tratado de Libre Comercio para América del Norte (TLCAN) se promulgó la Ley Federal de Variedades Vegetales (LFVV) para otorgar derechos de obtención vegetal. La LFVV traspone al derecho nacional una legislación armonizada con el Convenio Internacional para la Protección de Obtenciones Vegetales (CUPOV). La regulación de los límites de los derechos del obtentor es importante en vista de la estructura dicotómica de la agricultura en México. Por ende, se analizan los actos excluidos de la protección, las lagunas legales en cuanto a agotamiento y la ausencia de límites por interés público, y las licencias obligatorias.
其他摘要：One of the major changes during the process of change in the development model of agriculture in México, which started in the eighties, was the adoption of the industrial property system in plant varieties. On behalf of the commitment acquired by Mexico through the signing of the North American Free Trade Agreement, the enactment of the Mexican Federal Plant Variety Law (LFVV) granted PBR. The LFVV introduced into national law a harmonized legislation through the International Convention for the Protection of New Plant Varieties (UPOVC). The regulation on the limits of the breeder’s rights is an important view regarding the dichotomous structure of agriculture in Mexico. Therefore, we analyze the acts excluded from protection; loopholes in terms of exhaustion and lack of limits in the public interest; and compulsory licensing.
