摘要：DOI: 10.12957/rdc.2017.27045 O artigo em tela, por meio de pesquisa bibliográfica e método jurídico-dedutivo, examina, como tema-problema, a legislação de uso e ocupação do solo urbano brasileiro e a situação de permissividade de desmatamentos, impermeabilização do solo e consequente redução da refletância da energia solar, com efeitos de concentração na atmosfera, ainda, dos GEEs, que impedem a refletância solar para o espaço sideral, acumulando calor na estufa urbana. Hipoteticamente, a ocupação ordenada e preferencialmente verticalizada, amplia o número de moradas e reduz a área degradada em favor do equilíbrio ambiental. Justifica-se a pesquisa pela elevação da temperatura global decorrente do baixo nível refletância da energia solar, em virtude do desmatamento, impermeabilização do solo urbano e seus efeitos. Como objetivo geral almeja-se a descrição da dinâmica conjuntural dos fatores legais e fáticos ambientais permissivos ao paradigma de loteamentos urbanos e, como objetivos específicos, a análise da legislação afeta ao arcabouço do art. 225 da CRFB e crivo da Declaração de Estocolmo e da Lei n. 6.938, bem como demandas mitigadoras e promissoras da construção verticalizada, em observância aos fatores da gestão de uso da energia solar e ampliação urbana das áreas verdes. Abstract The article on screen, through a bibliographical research and legal-deductive method, examines, as a problem-theme, the legislation of use and occupation of the Brazilian urban soil and the situation of permissiveness of deforestation, soil waterproofing and consequent reduction of the reflectance of the Solar energy, with effects of concentration in the atmosphere, still, of the GEEs, that prevent the solar reflectance to the sidereal space, accumulating heat in the urban greenhouse. Hypothetically, orderly and preferably vertical occupation increases the number of dwellings and reduces the degraded area in favor of environmental equilibrium. It is justified the research by the elevation of the global temperature due to the low level reflectance of the solar energy, due to the deforestation, waterproofing of the urban soil and the resulting effects. The general objective is to describe the conjunctural dynamics of legal and environmental factors permissive to the paradigm of urban subdivisions and, as specific objectives, the analysis of the legislation affects the framework of art. 225 of the CRFB and the Stockholm Declaration and Law no. 6,938, as well as mitigating and promising measures of vertical construction, in compliance with the factors of the management of solar energy use and urban expansion of green areas.
