摘要：Neste eixo o Direito tem grande influência diante da política, neste tocante o Direito já não está subordinado à política como se dela fosse instrumento, senão é a política que se converte em instrumento de atuação do Direito, subordinada aos vínculos e a ela impostos pelos princípios constitucionais: vínculos negativos, como os gerados pelo direito às liberdades que não pode ser violado; vínculos positivos, como os gerados pelos direitos sociais, que devem ser satisfeitos . E ainda, o poder político tem a obrigação de sua autoridade normativa fundir-se com o Direito. Entretanto, essa reconstrução revela também que o Direito só mantém força legitimadora enquanto puder funcionar como uma fonte da justiça. E precisa continuar presente enquanto tal; ao passo que o poder político tem à mão, como fonte de força, meios coercitivos da caserna.
