摘要：La Constitución Federal brasileña de 1988 afirma en su artículo 1º, parágrafo único que todo el poder emana del pueblo, quien lo ejerce por medio de representantes o directamente en los términos de esta Constitución. La crisis que afecta al sistema democrático brasileño y la demanda de una mayor y mejor participación justifica un análisis sobre el grado de cumplimiento del mandato constitucional. La línea metodológica empleada consiste en el análisis sistemático del régimen jurídico de los derechos de participación establecidos en la Carta Magna: el plebiscito, el referendo y la iniciativa popular. Los resultados obtenidos posibilitan afirmar que la instauración de una democracia auténticamente participativa requiere ineludiblemente de profundas reformas constitucionales y legales que posibilitan una interacción ciudadana eficiente con las instituciones estatales.
其他摘要：A bst RA ct : The Federal brazilian Constitution of 1988 establish in its first article, unique paragraph that all the power comes from the people, who can exercise it through a group of representatives or in a direct way in the terms of this Constitution. The crisis affecting the Brazilian democratic system as well as the request for a better and deeper participation justifies an analysis about how this constitutional command has been fulfilled. The methodology line used consists in a systematic analyze over the legal regime related with the political rights established in the Constitution: the plebiscite, the referendum and the legislative initiative. The results obtained allow us to affirm that the implementation of a real participative democracy demands no other solution than profound constitutional and legal reforms that make possible an efficient action between the citizens and the state institutions.
