摘要:The new Brazilian Civil Procedure Code introduced contemporary general form of extra-judicial recognition of adverse possession, continuing a recent trend of legislative simplification of disputes and dismissal of court. This variant has existed in special cases in Brazilian law and the new modality extended to all forms of adverse possession. Part of the solution is inspired by Portuguese law whose registration Land Code has provided for the extrajudicial recognition. However, by demanding the consent of the owner, the new law introduced requirement hitherto absent in adverse possession, and it is fair to question whether there was a change of its legal profile, from original acquisition of property to a derived acquisition, stemming from a legal transaction between the owner and possessor.
